Terms of Service
Please read these terms carefully before using the notify-u platform. By using notify-u you agree to be bound by these terms.
About notify-u
notify-u is a transactional text message notification platform that enables businesses ("Organizations") to send their customers ("End Users") a single SMS pickup alert when a service ticket or order is ready. notify-u does not send marketing messages.
These Terms of Service ("Terms") govern your access to and use of the notify-u website, web application, and APIs (collectively, the "Service"). These Terms form a binding agreement between you and notify-u ("we," "us," or "our").
Accounts and Organizations
Organization Accounts
A business or individual ("Organization Admin") may register an organization account to manage tickets and send notifications to their customers. By registering, you represent that:
- You are authorized to act on behalf of the business or organization you are registering.
- All information you provide is accurate and will be kept up to date.
- You are at least 18 years of age.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.
End Users
End Users who opt in to receive notifications do not need to create an account. Their phone number is associated only with the specific ticket for which they opted in.
Text Message Consent and Opt-In
notify-u sends only transactional messages. End Users will receive at most one text message per ticket — a pickup notification. No marketing messages are ever sent.
End Users may opt in to receive a pickup notification in one of two ways:
- Verbal / written consent: The customer provides their phone number verbally or in writing to a business associate, who enters it into the system. The associate must inform the customer that they will receive one text message when their item is ready and that message and data rates may apply.
- QR code self-service: The customer scans a QR code on their ticket, opens the notify-u web form, reads the purpose statement, and submits their phone number.
By opting in, End Users agree to receive one transactional SMS per ticket. End Users may opt out at any time by replying STOP to any message received. For help, reply HELP or contact [email protected].
Message and data rates may apply. Message frequency is one message per ticket.
Organizations are responsible for obtaining valid opt-in consent before submitting a phone number through the Service. Organizations that violate consent requirements may have their accounts suspended.
Acceptable Use
You agree not to use the Service to:
- Send unsolicited, spam, or marketing messages of any kind.
- Submit phone numbers without the owner's explicit consent.
- Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) or any applicable state or local laws governing electronic communications.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service.
- Use the Service for any purpose other than its intended transactional notification function.
We reserve the right to suspend or terminate any account that violates these restrictions without prior notice.
Organization Responsibilities
Organizations using notify-u agree to:
- Obtain and document proper opt-in consent from all End Users whose phone numbers are submitted.
- Honor opt-out requests promptly and not re-subscribe End Users who have opted out.
- Ensure that associates and staff are trained on proper consent procedures.
- Keep their account information current and accurate.
- Promptly notify us of any data breach or unauthorized use of the Service.
Organizations are solely responsible for their compliance with the TCPA and any applicable state laws related to text message marketing and notifications.
Intellectual Property
The Service and all content, features, and functionality (including but not limited to software, text, graphics, logos, and designs) are owned by notify-u and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written permission.
You retain all rights to data you submit to the Service. By submitting data, you grant us a limited license to process and transmit that data for the purpose of providing the Service.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. SMS delivery is subject to carrier availability and we cannot guarantee delivery of every message.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOTIFY-U BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us at [email protected].
Upon termination, your right to use the Service will immediately cease. Sections 6, 7, 8, and 10 will survive termination.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Oakland County, Michigan.
Changes to These Terms
We may update these Terms from time to time. We will notify Organization Admins of material changes by email or by posting a notice in the Service. Continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
